$7.95 million Failure to Respond to Abnormal Fetal Heart Tones

This is a birth injury involving a tight time line in which hospital nursing personnel (both in Triage and in L&D) and the 3rd year resident (managing both areas) at Kaiser Roseville failed to appreciate abnormalities of the fetal monitor and failed to inform the attending OB of these abnormalities. A placental abruption was ultimately diagnosed. The failure to timely identify and respond to abnormal fetal heart tones (FHT’s), resulted in the delay of delivery, which led to severe fetal injury to the infant plaintiff.
