Severely Brain Damaged baby who sustained a brain injury at birth, and has been diagnosed with Cerebral Palsy and Global Developmental Delay; he also has a gtube.
This is a medical malpractice birth injury case involving a now 2 year-old child, Ryan Beilmann, who sustained cerebral palsy and global developmental delay as a direct result of a delay in delivery by C section on Jan. 13, 2015, at Pomona Valley Hospital. The delay occurred as a result of negligence by the hospital L&D nurses in failing to contact the attending obstetrician, Dr. D’Mitri Starks, prior to 7:40 am on Jan. 13, 2015, despite evidence of deep recurrent prolonged decelerations on the fetal monitor strip indicating fetal intolerance of labor. The nursing negligence was compounded by a further delay by Dr. Starks when he did arrive at 8:11 am in L & D but failed to perform a crash C section until 8:41 am. In addition, neither Dr. Starks nor the L&D nurses notified the NICU team about the likely need for resuscitation of the infant who was delivered limp, blue, and not breathing with APGAR scores of 1 at 1 minute, 2 at 5 minutes and 4 at 10 minutes of life.
